According to the filing, in August 2025, Ba purportedly attempted to circumvent European Union safety regulations during the release of Grok Code 1 by misrepresenting the model’s capabilities to evade mandated testing. The complaint indicates that Ba expressed a preference for releasing an unoptimized model over one deemed poorly performing, necessitating intervention from Musk himself.
The lawsuit claims Kim intended to present his findings on safety concerns the week of September 15, 2025. However, he was reportedly summoned to a meeting by Ba, who then informed him that they should “go [their] separate ways,” without providing a substantive explanation.

Kim is seeking compensatory and punitive damages, alongside a judicial declaration that the conduct of xAI and SpaceX was unlawful.
